I am proud to say I know Tommy Wilson. Thank God that someone in our judicial system has the inteligence and moral honesty to look beyond the letter of the law, which is an inherent part of any judges job.
I also applaud Genarlow Wilson for not accepting the Douglas Co. prosecutor's bs plea bargain, and therefore, accepting their flawed ideas of "moral" justice. To a person of strong moral character and convictions, like Genarlow Wilson, an admission of guilt where one is not deemed necessary, is worse than the alternative. I believe we can all learn something from this young man. Most people would have folded like a cheap tent and sold ourselves down the river in the face of such adversity. This young man stood strong behind his conviction of innocence because he knew there was nothing inherently wrong with what he did. Stupid? Yes. Childish? Yes. But, criminal? Hardly. I wouldn't expect the weak characters of the prosecution to understand this type of value and self worth a man of morals would place on his dignity and character. That is why the DA in douglas county, instead of answering questions with facts and reason that will support his absurd action, answers all questions by referring to the plea bargain he so generously offered, like it was his place to "offer" Genarlow his freedom in the first place.
I believe the law itself was poorly written by a joke of a legislature and the consequential happenings we are witnessing are nothing short than a failure of our judiciary system to ensure that justice is served.

I am currently in Oregon on business & have grown tired of hearing the comments about how bass-ackwards Georgia is. Thank goodness judge Wilson showed some common sense. Let's hope the AG & Governor do the same.

It's not just the Oregonians; this has been the lead story on CNN, Fox, ESPN & every other major news/sports network. The whole country can't believe we, not only have this law, but would actually sentence a high school student for 10 years.

If you've bothered to watch the video of the "party" in question, you could see for yourself this girl was no victim. The "truth" is the morals in this country have gone to hell, therefore, 15 year olds give consent to sex every day. If every 17 year old boy having sex with his 15 year old girlfriend were prosecuted, the prisons would be overloaded with teenagers.
Whatever your feelings about the case, AG Baker is correct in his assessment that the judge exceeded his authority. Unless you are in favor of judges not being bound by the law, rethink your rhetoric.

9:49. I agree that if the appelate judge overstepped his authority, then AG baker is doing the right thing legally. Allowing this judge the authority to do this would set a dangerous precedent that could lead to freeing real criminals.
However, AG baker has the power to take the appropriate measures and use some common sense to look beyond the letter of the law and make things right in this case using proper due process. However, if he won't do it, someone has to do something. If Judge Wilson didn't have the power to overturn the decision, why was it allowed to be tried in the first place? It seems to me that this is a disastrous power struggle between a side doing what is right, and a side trying to flex a little muscle. Too bad there is a human life being destroyed so these politicians can vie for power.
And those of you making comments about race and "jocksniffer" judges are missing the point and are showing your ignorance. I am white, and don't care if this kid was white, made straight D's, and played the flute in the highschool band, he did not sexually molest this young girl and for him to be penalized for doing so, is a travesty of justice. Everything else is a non-factor.

If you are going to change the law for this person, who was convicted on the law that was imposed on him then, the law ought to be changed for the rest of the guys that have been convicted and sentenced to serve time for basically the same crime. "IF IT IS CHANGED FOR ONE PERSON THEN APPLY THE SAME RULES TO THE OTHER GUYS THAT WERE SENTENCED FOR THE SAME CRIME." If the parents of these young girls would start keeping up with them at night instead of letting them run the streets at all hours of the night, then we wouldn't have such a problem with the guys taking advantage of the situation and taking what these girls freely give. GUYS NOWADAYS YOU HAVE TO ASK FOR ID's BEFORE YOU LEAP INTO BED WITH THESE GIRLS.
IN some cases the state won't do anything, take my case for example; I have 2 teenaged granddaughters that are allowed to do as they please. But try to tell DEFACS about your concerns for their safety and they say that you are just looking for something to complain about. I also have a grandson that I suspect is being sexually abused but DEFACS won't investigate. You tell me where can you go if the DEFACS people won't investigate. They tell me that is is just hearsay because the child doesn't know how to tell anyone and that they can't do anything to stop it.

The AG is doing the responsible thing. Lawyers for over 50 other convicts are now licking their chops on the basis of Wilson's decision. It is an axiom of the law, that often times humane decisions based on idividual circumstances make for bigger problems down the road.

I agree with you and in no way question the amount of lawyers out there looking for a little recognition. That was the entire purpose of my first paragraph in my previous post. What he has done may be the correct and responsible thing on a legal basis, but there has to be other measures that a responsible party, be it the governor, legislature, or AG Baker, can take to prevent miscarriages of justice like this from occuring.
However, if these other "criminals" are in the same situation as Genarlow Wilson, and are being convicted for a high school romance, for lack of a better word, then I have no problem with them being released. This case actually got more attention, I believe, because of the harshness of his sentence. I know of two young men, one in augusta, and one in macon, that have been convicted on similar charges and have done time for hooking up with someone a year or two younger than them. My point is that the law was poorly written in the first place and that this young man was convicted on a technicallity. If he would have had sex with the girl, he would have been charged with a misdemeanor. Noone can say that he was "preying" on this girl, and especially wasn't using his 1 1/2 year age advantage to take advantage of her youthful vulnerability. It is beyond me how none of the parties responsible for this young man's false imprisonment can not look far enough beyond the law to realize that it needs to be changed because labeling and charging him as a CHILD MOLESTER is absurd.

The legislature has already said no. If you expect anything from Governor Moon Pie, think again. I doubt the young man has contributed to the Gov's campaign which seems to be the only way to get him to do anything.

I believe an inherent definition of racism is to inject race into an issue where it has no bearing. Anon 6:04 has sunk to the lows of Al Sharpton and Jesse Jackson.
I think I had read that the legislature denied several motions filed by Mr. Wilson's attorney. However, I don't understand their basis for this after they can use his case as support for changing the law for which they are keeping him in jail. His case was absurd enough to bring about the procedures to change the law, but not enough to set him free under the new law.

Question, What would everyone think if the 17 yr old was a girl and she was the agresser with a 15 yr old boy. Would 15 yrs in prison be right for her? I don't think so. It was just another example of the Southern Justice system at it's finest. Hopefuly the georgia justice system will become a justice system where Judges will use common sence insted of the book for evey sentence like Tommy Wilson did. Maybe the days of the Hal Craigs are over.
One problem is that the legal system is just that. Not a justice system. Their has been very little justice in the legal system in Monroe county throughout the years. It looks like Tommy Wilson may finally level the playing feild. Good for you Mr. Wilson.
