c&d landfill rears its ugly head again...
the lamar county commission voted reluctantly but unanimously tonight to reopen hearings on the rezoning of 312 acres off possum trot road for an unlined landfill for construction and demolition debris.
e.t. carlyle company first sought rezoning for the landfill in 2001. it won a lengthy court battle on may 30, 2006 when judge e. byron smith ordered the county to restart the rezoning process.
the commission voted tonight to comply with that court order.

I find it hard to believe the state allows unlined landfills!
Why worry about global warming when the contaminated groundwater will kill you first.
I wonder about this too. I would think a lined land fill would be more productive, and help to secure the underground water. Hmmmmmm, some think they are smarter than the rest of us.
YOu want to b--ch about the landfill but you still chose to use disposable diapers and other throw away items that are convenient. Have you ever stopped to consider where all of these items end up? They don't disintergrate for a very long time and they have to be put somewhere. So why not in your backyard.
As I read the decision in Lamar County v. E.T. Carlysle, 277 Ga. 690, (2004) the Supreme Court held that the County's decision to deny the special exception was correct. The Supreme Court found that Judge Byron Smith's logic was flawed and he ignored clear evidence in the record. (Where have I seen this happen before--the Florida Rock case--Judge Smith was reversed there too but the County caved before the Court of Appeals decided in the County's favor). However, Judge Smith, did not consider some of the contentions that Carlysle raised. Thus, the reason for the rezoning hearings. Rumor has it that the Board of Commissioners, in order to avoid more lengthy litigation with Carlysle will approve the zoning and special exception this time, and dump the case in the EPD's lap hoping that it will not approve the landfill. WARNING: DO NOT BELIEVE IT IF YOU HEAR THAT THE BOARD OF COMMISSIONERS HAS NO CHOICE BUT TO GRANT THE ZONING. THEY CAN DENY THE ZONING JUST LIKE THEY DID BEFORE AND WIN. INSTEAD, THEY DON'T WANT A LEGAL FIGHT WITH CARLSYLE AND WANT TO GAMBLE WITH OUR FUTURES THAT THE EPD WILL DENY A PERMIT. WE MUST STAND UP AND FIGHT THIS. An unlined landfill is a danger to our wells and our water supply. Our commissioners must stand up for us and do what is right and not gamble that the EPD will protect us. The EPD people do not live here and they have admitted that they don't have the money or the manpower to police corporations. This landfille must be stopped.
What does the picture of a solid waste dump in Ireland have to do with the contruction/demolition site that is proposed for Lamar Co? Seems like two different kinds of trash.
Ireland trash looks nastier but their whiskey kicks some ass!

Thank you for your concerns about our county. However, you are wasting you time making comments on here. Please call The county attorney in this case and share your thoughts with him. You may just help him see something he is missing if he is or he may help you see something you are missing. I do not believe the commissioners want this to happen. They have just been advised this is the only thing they can do evidently. So please call the advisor (in this case the attorney) and share your wisdom with him. You seem to have some good points if what you sate is true. I don't mean to imply that you are not being truthful, but sometimes what appears to be the case is not always the case. But please be constructive with your knowledge and don't just get on this blog make comments that we have no idea if it will help stop the landfill. Please be sure to keep us informed of your discussions with the county attorneys.
good point joe public. i don't think the county attorney will share with anyone the advise and council he gave to the commission due to potential future litigation.
Speaking of trash, I thought one of the current Sheriff's "promises" was that he would have inmates picking up trash on the side of the road. What ever happened to that promise. So much with promises. While I am ranting our head commish better get his head and his concerns out of giving county land to the city of B Ville and start worring what is happening in the north end of the county.
