heroic customer shoots robbers...

Some are calling a former U.S. Marine a hero for shooting two men — killing one — during the botched robbery of a sandwich shop in Plantation. But the men's friends and family want to know how he could gun them down and not be charged.

John Lovell had just finished dinner at about 11: 15 p.m. Wednesday when, Plantation police say, two men armed with guns rushed inside a Subway shop and demanded cash. After robbing the store, the men turned to Lovell. They wanted his money, police said.

But like his attackers, Lovell was armed.

The retired military man opened fire, shooting dead Donicio Arrindell, 22, of North Lauderdale, and critically injuring Fredrick Gadson, 21, of Fort Lauderdale.

Lovell, 71, of Plantation, has a valid concealed weapons permit and is not expected to be charged in the shooting, said police spokesman Detective Robert Rettig. Gadson, however, faces multiple felony charges that could include murder, he said. Under Florida law, anyone who commits a felony such as armed robbery resulting in a death can be held accountable for the capital offense.

"He feared for his life," Rettig said of Lovell. "And if he's in fear for his life, then he has a right to defend himself, even if it means severe bodily injury or death."

Florida law gives people the right of "self-defense without the duty to retreat." That means individuals can use deadly force virtually anywhere to prevent death or serious injury.

Lovell could not be reached for comment despite calls and visits to his home.

His attorney, Wesley White, of Yulee, near Jacksonville, said he has known Lovell for 19 years and described him as a "quiet Clint Eastwood-type you don't want to mess with." He is a former Marine who was a member of the helicopter detail that transported Presidents Kennedy and Johnson, White said.

Lovell, a retired Pan-Am and Delta Airline pilot, has held a concealed weapons permit since September 1990. Three months earlier, Plantation police had arrested him for having a loaded .9 mm and three extra clips behind the driver's seat of a Corvette without proper permits for the gun. The Broward State's Attorney's Office declined to file charges in that case.

According to a police statement, Arrindell ordered Lovell to hand over his wallet. He intentionally dropped it on the floor and refused to pick it up, saying he was afraid. That's when Arrindell ordered him into the women's restroom.

"The victim believed he would be executed and when he noticed [Arrindell] distracted ... reached behind his back, removed his loaded .45 caliber handgun from his holster and fired seven rounds," the statement said.

Arrindell was struck twice — once in the head and once in the stomach — and collapsed. Officers found him face down, wearing sunglasses and a bandanna, with a gun near his left hand. Gadson was hit in the chest and ran from the store. Police dogs found him in the hedges of a nearby office building and bank.

Both men were taken to Broward General Medical Center, where Arrindell died and Gadson was in critical condition Thursday.

Sebastian Shakespeare, 23, of Lauderhill, was going to buy a sandwich at the Subway at 1949 N. Pine Island Road when he saw Lovell, gun in hand, standing over Arrindell. A former employee, Shakespeare worked the night shift and often worried about getting robbed.

He said Lovell did a good deed. "A civilian was a hero."

Lovell's neighbor agreed.

"If I was in the same situation ... I hope I could've done the same thing," said Bryan Sklar, 45.

But Gadson's grandmother, Rosa Jones, said: "He ain't no hero. He is a murderer and God will serve justice."

She and her husband, Ivory Jones, pastor of a Fort Lauderdale church, sat on their front porch in Fort Lauderdale on Thursday wondering how a man could shoot two people and not go to jail.

They said their grandson sometimes hung with the wrong crowd but never got into legal trouble. According to the Florida Department of Law Enforcement, he has no arrest record. They said Gadson, who never finished high school, got tired of low-wage jobs and was pursuing his GED.

Arrindell, friends said, found himself in a similar situation: no high school diploma and working odd jobs. So he went back to school. He was a man with past troubles, including a 2004 arrest for carrying a concealed weapon, but he was improving his life, they said. He recently bought a car and had a girlfriend.

Kathy East, 54, whose son went to school with Arrindell, said she took him in two years ago when he and his mother had a falling out.

"I'm absolutely stunned," she said Thursday.

Amen somebody had the nerve to stand up for his rights. If you were the one that was in his situation you would probably have done the same thing. The guys that were robbing the place were in the wrong and when they ordered him into the ladies bathroom what do you think they were going to do to him? More people should start standing up against the criminals. Maybe then there wouldn't be so much crime going on.

Interpertaion: He was the wrong crowd and never been caught breaking the law.

If more people would carry a gun, it would make these thugs think twice that there is a good chance thier a$$ is going to get shot!

This grandmothers comments shows the huge problem in the black community. The criminal grandson, who was raised by his grandparents I'll bet, did nothing wrong its the law abiding citizens fault he is dead. IF and I mean IF the black community ever gets it self on track and starts taking blame for thier own ignorant actions they will surely prosper as a people. When the coolest thing you can do is drop your pants off your ass, get someone pregnant, listen to the worst type of crap called music ever created and not have to worry about having a job because your culture as a whole doesn't see it as neccesary, what do you expect these little wastes of sperm to do. Look at every government and every area where the black community "flourishes" and you will see the same empty future and this empty future is self-served and rewarded by the U.S. Government.
Think about this, if a citizen is on welfare shouldn't the government have the right and responsibility to drug test these people between the hours of 9 to 5 since they are a government employee- the government is giving them thier source of income- if they fail the test fire them, let them starve, use your 2nd amendment if they resort to stealing or crimes against you and make America a better place. That goes for all the lazy pieces of poo in the USA. TODAY IS A GREAT DAY TO BE AN AMERICAN-RELOAD!

I'm so sick of people like you on here talking about black people. Not all black people are the same...just like not all white people are the same.

I am black, college educated (with 2 advanced degrees)gainfully employed and so is my husband as well as our parents and siblings. We were married, like our parents, bought a home (again, like our parents) in this county and 4 years later had our first child who is being exposed to great cultural, academic and recreational activities. We pay taxes, we are law-abiding and don't bother anyone. The black people that I see are very much like me. However, we all continue to be judged by a few. When will it ever stop?

Is the entire white race judged by a small group? There are many undesireables there as well!

So before you come on here spewing your nonsense, make sure that you have a basis for your rant.
For starters:
EVERY SINGLE BLACK PERSON IS NOT CRIMINAL.
EVERY SINGLE BLACK PERSON DOES NOT WEAR THEIR PANTS AROUND THEIR KNEES!

Here is another example. Ride around Barnesville and go to different areas of town and see who is at work and who is not. See who is walking the streets and sitting on their front porches or hanging around on the sidewalks drinking and or selling drugs. Go at anytime day or night. See who your tax dollars are paying to not DO A DAMN THING! Its quite obvious.

i have spent the past 21 years working in and with some of the very best and brightest people in private industry. i have had the opportunity to observes first hand many very bright black manangers and executives. i have NEVER, EVER seen a black manager that you could put into a group with other blacks (regardless of social status) who did not immediately throw in with them and ALL revert back to a home-boy street brother status, shuckin' and jivin' all the way.

Better a trailor than a slum house in a slum neighborhood! No it is not only black people we have a lot of sorry good for nothing white and all other colors of people who live off the sweat of someone else's brow. Why can't the gov't. put a stop to the welefare state let every one fend for themselves of fall by the way side.
As for the pants around their knees I think it is disgusting that the guys think that it is cool, to me it just looks nasty I don't care to look at them but then you can't drive with your eyes shut. Most companies that choose to hire minorities usually go out of business within a short period of time because most of them are slackers if they did what they should be doing while on the job and leave the socializing on the street corners where it can be done on your own time then america would not be going over seas to find workers who will work hard to earn their pay. I applaud every one of you that choose to get the education to better yourself but you better not get too much above your raising or you will be one of the ones the sorry ones will cut you down.

Then obviously you are not in the category I am speaking of but you are black and you can not expect people to look inside your mind or heart when they pass you by or meet you for the first time, I'm not saying don't give someone the benefit of the doubt, all I'm saying is the mental picture of black America is not a good one, not a bigot, not raised that way, just being honest. This image has to be changed by people like you, the culture needs to turn over a new leaf. The current state of it is largely undesirable except for those who act this way themselves, if you see these words I write as hatefull it proves my point about the lack of responsibility and being angry when this is adressed by another culture or race. It doesn't bother me if black people talk about not agreeing with the WHITE TRASH life style, I don't agree with it and in return wouldn't hire white trash or trade with white trash- too irresponsible. sorry bout the spelling- in a hurry.

This is considered racial profiling but if you statistically consider the crimes, the welfare recipients, the drug users, the unemployed, the undereducated, and the just down right sorry, you will see that it is minorities that lead the pack. Blacks then hispanics. If I see you 10 times and 9 times you are doing something, I will think that you do that most of the time. When crimes are reported on the news and 90 times out of a 100 they are either black or hispanic, well you just think that blacks and hispanics commit most of the crimes. That's just the way it is. The only way to change that perception is to CHANGE your culture. I don't consider myself a racist but when I hear about certain crimes most of the time I do think that a black or hispanic did it. Drug violence, gang violence, riots, looting.

I grew up in Plantation in South Florida and it was a good safe place to raise a family but with the influx of drugs during the late 60's and 70's it became a very dangerous place to be. People should be able to protect themselves were ever they are and use all and any means to do it.
