if only nine of 12 jurors in a capital case approve execution?
currently, juries must be unanimous for the death penalty to be imposed.

I dont know how I feel about the question. I feel the entire Jury must support that verdict, and the Judge apply the verdict as dictated by the Jury. I guess that is something Lawyers will make alot of the taxpayers money appealing that decision to the Supreme Court.
They aren't going to put them to death anyway so who cares who imposes the sentence. This is what you call a moot question.
Judges should sentence. They aremore likely to impose by law than a jury
Grandalf you have a good point. The public defenders, whom we pay, just keep appealing a sentence, until the person dies a natural death. At the same time has convicted the person they are innocent, even though they blew the persons brains out.
