county loses c-store lawsuit...

judge tommy wilson has ruled in favor of property owners dee, johnny and eric mcleroy who desire to place a convenience store at the intersection of highway 41 north and trice road.

wilson called the county's denial of the zoning for the store "arbitrary and capricious" and "unconstitutional".

he also ordered the county to grant the rezoning from ag.-residential to commercial, clearing the way for the store barring an unlikely appeal.

the commission will take up the matter november 14.

This should have been granted long ago.

Is this some additional legal fees that will need to come out of the SPLOST funds?

FYI
If you are going out of town on election day (Nov.7), you can go to the registrar's office and vote NOW... It's easy to vote a write in vote too. Just touch the screen where it says "write in" and a keyboard pops up. Type the person's name and then hit "record." Very easy to do.

i agree with the ruling, but I sure hope they put some type of restrictive convenants to prevent it from looking like a cheap looking one stop.

Just an opinion -
If we allow many more metal buildings to go up the we should change our town's name from Barnesville to Metalville. I for one am sickened by the unattractive appearance of all these metal buildings

This has been granted after the Mcleroys spent thousands on something that should have been granted at the commision meeting. Guess who else spent thousands on their attorney. Right, the property owners of Lamar county since our county commisioners vote the correct political position rather than what is correct and right for the majority of the county. Commercial property begins 2 miles north of this property and doesn't end untill a point north of Catersville, Ga. Open your eyes honorable commisioners.

I applaud the idea of voting out incumbents. I think anyone who has served more than one term needs to find something else to do.

WHO CARES. CERTAINLY NOT THE FINE FOLKS IN LAMAR COUNTY. EXERCISE YOUR RIGHT TO VOTE. IT WON'T MAKE ANY DIFFERENCE. WE HAVE NO ONE RUNNING FOR OFFICE ANYWAY. IT WILL ALL APPEAR ON THE UP AND UP EVEN THOUGH THE OUTCOME WILL BE THE WAY A FEW FOLKS WANT IT TO TURN OUT. BUT, WHO CARES!!!!!!!!!!!!!!!

Just a comment to Judge Wilson. I know we can't stop businessess from coming, but why another convenience store in the backyards of people who's families have worked hard to live in the country. One lady (single & has a small child) will be right across from this store. I'm sure she will be scared. Also, Judge Wilson have you looked at the intersection? This will be another dangerous one. All the trees will be pushed over, the land will be nothing but concrete and lights, with smelly fumes, lottery tickets and other trash thrown out cars going on our highway and Trice Rd. We won't be able to look up at the sky on pretty nights and see the stars because the lights will make them disappear. Please think about this. I do every day and I am sorry but I pray it won't happen. Thanks for listening. My heart aches that people are interested so much in destroying our country only to earn a buck.
